Billing Of Services

Effective Date: These Billing, Cancellation of Services and Refunds were last updated on November 18th, 2020.

Clicking to accept the terms of Billing, Cancellation of Services and Refunds where this option is made available to you in the user interface or Usage of Service Provider products and services constitutes your acceptance of Service Provider's Billing, Cancellation of Services and Refunds policy.

All Services are provided with a one time, 14 Days of Free Service.  After the 14 Days of Free Services and Reactivations are setup on a monthly prepaid basis. Before service is activated/provided, Service Provider must receive payment.

Service Provider accepts payments by credit or debit card. You are required to keep a valid credit or debit card on file for all recurring monthly subscription fees and all additional charges related to provided services. Subscription billing is based upon availability of products and services and not on usage.

Invoices are generated and collected at the beginning of your billing cycle. Service fees collected will not be pro-rated or refunded unless covered by our Refund Policy.

By signing up for any Services provided by Service Provider and providing either credit card or debit card, the user consents to the subsequent recurring billing for Services provided by Service Provider. Recurring billing will continue until terminated by either party as set forth in Service Terms and Conditions. Billing may be processed and displayed on users credit card statement as Service Provider.

Nothing in these terms shall exclude or limit Service Provider warranty or liability for losses which may not be lawfully excluded or limited by applicable law. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages. Accordingly, only the limitations which are lawful in your jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law.

You expressly understand and agree that your use of the Services is at your sole risk and that the services are provided "as is" and "as available".

Service Provider or its subsidiaries and affiliates do not represent or warrant to y that your use of the Services will meet your requirements. Namely, Service Provider or its subsidiaries and affiliates do not represent or warrant your use of the Services will be uninterrupted, timely, secure or free from error. Service Provider or its subsidiaries and affiliates do not represent or warrant that any information obtained by you as a result of your use of the services will be accurate or reliable. Service Provider or its subsidiaries and affiliates do not represent or warrant that defects in the operation or functionality of any software provided to you as part of the services will be corrected.

Any material downloaded or otherwise obtained through the use of the services is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or other device or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from Service Provider or through or from the services shall create any warranty not expressly stated in the Terms.

Service Provider further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

Cancellation of Services

Terms will be applied until Service is ended by either you or Service Provider as set out below:

If you want to terminate your legal agreement with Service Provider, you may do so by (a) notifying Service Provider (b) closing your accounts for all of the Services which you use, where Service Provider has made this option available to you. Your notice should be sent, in writing, to Service Provider's address available on website www.archagent.com, or send in a chat via our website, provided however that such written notice, email/chat notice is not deemed received until you receive a confirmation of receipt from Service Provider.

Service Provider may terminate service at any time if the Terms of any provision put forth in Terms has been violated or if you are unable to comply with any provisions of the Terms. Additionally, service may be terminated if required by law or if a partner of Service Provider has terminated its relationships with Service Provider or ceased to offer the Services. Service Provider may also terminate service if in our opinion the service is no longer commercially viable.

Refund Policy

 

Refund Policies for services provided by ArchAgent.

The ArchAgent PowerDialer, Expired, For Sale By Owner, For Rent by Owner, Preforeclosure, and Neighborhood Data Services are made available with 14 days of Free Service.  There are limitations on augmentations for Premium Neighborhood, Preforeclosure and For Rent By Owner listings.  During the 14 days of Free Service there are limitations on exporting of data on all Services. 

If the subscriber chooses not to continue the Service, it is the subscriber’s responsibility to cancel the Service before the end of the 14 Free Days of Service in order to avoid subscription charges.  All cancellations require receipt of cancellation to be valid.  A cancellation submitted via our website or portal chat is automatically logged the day it is received and is valid for cancellation.  Cancellations made by phone or email must receive a receipt of cancellation to be valid.  Subscription billing is based upon availability of products and services and not on usage.  No refunds are given to subscribers who forget to cancel, cancel without confirmation receipt or for any other reason. 

Data append services represent real charges incurred and are not subject to refunds in any circumstances.
